“What Happens If I Am In the Middle of a Divorce and My Spouse Dies?”

Short answer: Divorce proceeding ends because the marriage ended at the death of the person.

Long answer: There still needs to be decisions about the money, things, property, and children.

Now all these decisions are made in probate court. Probate court is where your estate plan (your Will) comes into play.

If you are contemplating divorce, in the process of a divorce or almost at the point of finalizing a divorce, speak with an estate planning attorney to get your plan updated.

If you have an updated estate plan, that new Will has a fighting chance of ensuring what you want to have happen to your money, things, property, and children will be followed.

If you do not have a plan, you will have NO opportunity to voice what you want to have happen.
